EAD Renewal Timing: Avoiding Work Authorization Gaps

Start with your category and expiration date

Look at the category code on your EAD (for example, C09 or C08) and the expiration date. Your category determines how early you can file and whether automatic extensions apply.

File early when allowed

Many categories can file Form I-765 up to 180 days before the current card expires, but not all categories follow the same rule. Always confirm the filing window in the I-765 instructions for your category.

Know when automatic extensions apply

USCIS grants automatic extensions for specific categories when a renewal is filed on time. The extension length and eligibility depend on your category and the type of application. If you rely on an automatic extension, keep the receipt notice with your expiring EAD. USCIS has adjusted extension periods in recent years, so confirm the current duration on the USCIS automatic extensions page.

Build a strong renewal packet

  • Copy of the front and back of your current EAD.
  • Filing fee or approved fee waiver.
  • Proof of your underlying status or pending application.
  • Updated address and identity documents, if needed.

Plan for your employer's I-9

Employers must reverify work authorization. Bring your receipt notice and any automatic extension guidance if your category qualifies.

If a gap is likely

If your card may expire before approval, consider discussing options with an immigration attorney. Some cases may qualify for expedited processing, but the criteria are limited.
