Told there is no bond hearing? In Oklahoma, that answer may be out of date.

What an Immigration Habeas Petition Costs, and Why

Every detention case is different, so there is no single price. Here is what drives the cost, and how to get a clear answer for your family's case.

  • A $150 consultation is paid time for the attorney's legal assessment of the detention itself: which custody statute ICE is relying on, which federal court has the case, and whether a habeas petition fits.
  • Habeas petitions for people held in western Oklahoma are filed in the U.S. District Court for the Western District of Oklahoma, where the attorney is admitted.
  • By phone, Google Meet, or in person in Tulsa. Interpreters available. Forms and messages get a reply by the end of the next business day, by text or email.

Families often ask the price before anything else, and that is a fair question when someone is detained and money is tight. The honest answer is that the cost depends on the case. This page explains the main factors so the number you hear after a consultation makes sense.

The consultation is $150. It is paid time for the attorney's legal assessment of the detention: which custody statute ICE is relying on, which federal court has the case, and whether a habeas petition fits at all. Sometimes the answer is that bond, an appeal, or another route fits better, and it is better to learn that before paying for a petition.

Consultations are by phone, Google Meet, or in person in Tulsa. Interpreters are available.

A habeas case is federal litigation, so the work is shaped by what the court and the government do after filing.

  • How the government responds: some cases are resolved on the petition and a response; others need a reply brief or more.
  • Whether a bond hearing follows: if the court orders one, preparing for and handling that hearing is additional work.
  • Transfers: if ICE moves the person to another state, the right court can change, which can mean refiling.
  • Urgency: a motion to expedite or other emergency filings add work.
  • The record: gathering immigration court records, documents, and translations takes time.

A transfer can change which federal court has the case, so the detention is worth reviewing early: which custody statute applies, where a habeas petition is filed, and whether bond is the better route.

If the firm takes the case, the fee is written into an engagement agreement before work starts, so the family knows what is covered. Nothing is filed until that agreement is in place.

Habeas petitions for people held at Diamondback (Blaine County), Cimarron (Payne County), and the Oklahoma City area facilities are filed in the U.S. District Court for the Western District of Oklahoma, under 28 U.S.C. section 116. The attorney must be admitted in that court to file there. The firm's attorney is admitted in the Western District.

After detention, a case may involve ICE hold decisions, transfer movement, Notice to Appear filings, and master calendar hearings.

Depending on legal posture, bond hearing strategy and removal-defense options may be evaluated early. If you were told bond is unavailable because the person entered without inspection, that should be rechecked: the Tenth Circuit held in Santillan Quiroz v. Mullin, 180 F.4th 1226 (10th Cir. 2026) that people detained in the interior are usually bond-eligible under 8 U.S.C. section 1226(a), and federal courts in Oklahoma have been ordering hearings on that basis.

Can you tell me the price over the phone?

Not responsibly without knowing the case. The $150 consultation is where the attorney reviews the situation and can explain what the case would involve.

Is the consultation a review of all our documents?

No. The consultation is the attorney's legal assessment of the situation. A full document review is a separate, larger piece of work.

Does paying for a habeas petition guarantee release?

No. No attorney can promise an outcome. A petition asks a federal judge to decide whether the detention is lawful.

La consulta cuesta $150 y es tiempo pagado para una evaluación legal de la detención. El costo de una petición de habeas depende del caso: la respuesta del gobierno, si se ordena una audiencia de fianza, traslados y urgencia.
