I-765 Category Code Mistakes: Why the Work Permit Basis Matters

Form I-765 is not just a work permit form. It asks USCIS to decide whether the applicant qualifies under a specific employment authorization category. If the category code is wrong, missing, or unsupported by the evidence, the case can be rejected, delayed, or denied.

Common problems include using an adjustment of status category when the I-485 is not properly pending, using an asylum category before the applicant is eligible, filing under a spouse category without proof of the principal status, or mixing renewal and replacement reasons. A prior EAD approval does not always prove that the same category still applies.

The evidence should match the selected category. That may include receipt notices, approval notices, I-94 records, marriage certificates, principal applicant documents, pending case notices, or proof that an automatic extension rule applies. The filing should also use consistent names, dates of birth, A-numbers, and mailing addresses.
