A K-1 fiance petition usually must show that the couple met in person during the two years before filing Form I-129F. When that did not happen, the case needs more than a simple explanation. The petitioner must request a waiver and document why the legal standard is met.
Common waiver theories involve extreme hardship to the U.S. citizen petitioner or a conflict with strict, long-established cultural or social customs. General expense, busy schedules, or ordinary travel difficulty usually will not be enough by themselves.
