N-400 DUI and Good Moral Character: What Naturalization Applicants Should Prepare

A DUI does not automatically mean a naturalization case will be denied, but it can create a serious good moral character issue. USCIS reviews conduct during the statutory period and can also consider older conduct if it appears relevant to the applicant's present character.

The most important first step is to obtain complete certified court records, not just an online docket screenshot. The file should show the charge, plea or verdict, sentence, probation terms, alcohol program, fines, ignition interlock requirements, and whether everything has been completed.

Timing matters. Naturalization generally will not be approved while probation, parole, or a suspended sentence is still active. Multiple alcohol-related incidents, missed court obligations, false answers on the N-400, or a pattern suggesting habitual alcohol abuse can make the case much harder.
