O-1 Consultation Letters: Why the Advisory Opinion Can Matter
O-1 Consultation Letters: Why the Advisory Opinion Can Matter
Many O-1 petitions require a written advisory opinion from an appropriate peer group, labor organization, or management organization. The consultation is not the whole case, but it can influence how clearly USCIS understands the applicant's field, achievements, and proposed work in the United States.
A useful O-1 consultation letter should come from the correct type of organization, identify the beneficiary and petitioner, describe the field, and address why the applicant's record supports the requested classification. Generic praise is weaker than a letter that connects the applicant's awards, press, judging, original contributions, leading roles, commercial success, or expert recognition to the O-1 standard.
Some cases may qualify for an exception or use prior consultation evidence, but that should be analyzed carefully. Filing without a required consultation, submitting the wrong type of letter, or relying on an organization that lacks connection to the field can create an RFE or denial risk.
New Horizons Legal helps artists, founders, researchers, athletes, and employers build O-1 petitions that connect consultation evidence with the larger extraordinary ability record.
