Asylum One-Year Filing Deadline: What to Do Before It Is Too Late

Asylum One-Year Filing Deadline: What to Do Before It Is Too Late

Many asylum seekers lose strong cases because they miss the one-year filing deadline. In general, you must file for asylum within one year of your last arrival in the United States. Missing that date can make approval much harder.

There are exceptions, including changed circumstances and extraordinary circumstances, but you must prove them with evidence. Examples include major political changes in your home country, serious illness, legal disability, or ineffective prior representation.

Do not wait until your deadline is near. Start gathering identity records, country-condition reports, police or medical records, witness declarations, and a detailed personal statement. Your statement should explain harm, fear of return, and why you qualify under a protected ground.

If you are in immigration court, your filing timeline and court deadlines must be handled carefully. If you are filing affirmatively with USCIS, early filing can protect work authorization timing and reduce risk.

A rushed asylum filing often creates contradictions that hurt credibility later. It is better to build a consistent legal theory from day one.
