DV Lottery Adjustment of Status: Timing, Visa Bulletin, and Filing Risks

This guide explains timing issues for Diversity Visa selectees who are physically in the United States and want to file adjustment of status. DV cases are unusually time sensitive because eligibility depends on visa availability and the fiscal year deadline for that DV program.

A selectee should track the Visa Bulletin, the case number, chargeability country, current status, inspection and admission, and any inadmissibility issue. Being selected is not the same as receiving a green card, and waiting too long can make an otherwise strong case impossible to finish.

Documents often include identity records, birth and marriage certificates, status records, I-94s, passport pages, police or court records if relevant, medical exam planning, financial evidence, and proof that the applicant has maintained eligibility to adjust.
