Changing Immigration Lawyers: How Form G-28 Affects USCIS Notices

Changing immigration lawyers is not only a billing or strategy decision. It can affect where USCIS sends notices, who receives RFEs, and who is authorized to speak for the applicant or petitioner.

Form G-28 is the notice of appearance for an attorney or accredited representative in many DHS immigration matters. A new G-28 can tell USCIS that a different representative is handling the case, but it should match the applicant's signature, receipt number, mailing address, and pending form type. Immigration court and Board of Immigration Appeals matters use different appearance forms, so court cases should be reviewed separately.

The main risk during a lawyer change is a missed deadline. Before changing representation, make a list of every pending receipt number, online account, interview notice, RFE, NOID, biometrics appointment, and appeal deadline. Ask for a copy of the file, confirm the current mailing address, and keep delivery proof for any new filing.

New Horizons Legal helps clients transition representation without losing track of case deadlines. A careful G-28 update can protect communication, clarify who is responsible for next steps, and keep the case moving after a change in counsel.

Immigration consultations available, subject to attorney review.
