H-1B Recapture Time Abroad: Extending the Six-Year Clock

H-1B workers often think the six-year limit is a fixed calendar deadline. In many cases, time spent outside the United States during H-1B validity can be requested back, or recaptured, in a later extension petition.

The strongest recapture requests are built on clean travel records. Useful evidence includes I-94 travel history, passport stamps, boarding passes, flight records, prior approval notices, and a day-by-day chart showing each absence from the United States.

Recapture is not the same as an AC21 extension based on a pending PERM, approved I-140, or visa backlog. Some cases use both strategies, but the evidence and legal theory are different. Employers should also avoid waiting until the last moment because travel history can take time to reconstruct.
