H-1B to Green Card Timeline: PERM, I-140, and I-485 Steps

Many professionals on H-1B assume green card processing is automatic once an employer agrees to sponsor. In reality, delays usually come from planning gaps, document errors, and misunderstanding priority date movement.

Stage 1: PERM Labor Certification

Most EB-2 and EB-3 cases begin with PERM, which includes:

  • Prevailing wage request
  • Recruitment process
  • ETA-9089 filing

This stage can take many months depending on processing times and audits. Employer compliance in recruitment records is essential.

Stage 2: I-140 Petition

After PERM approval, the employer files Form I-140. Key issues include:

  • Correct job classification
  • Ability-to-pay evidence
  • Beneficiary qualifications

Premium processing may speed I-140 adjudication, but it does not fix underlying PERM or priority date issues.

Stage 3: I-485 Adjustment of Status

You can file I-485 only when the priority date is current under the Visa Bulletin. For some countries, this is the longest delay point.

Concurrent filing may be possible when dates are current, allowing EAD and advance parole applications.
