I-485J Portability Under AC21: When Can You Change Jobs Safely?

Changing jobs during an employment-based green card case can be possible, but timing matters. AC21 portability may allow a worker to move to a new employer if the I-485 has been pending long enough and the new role is in the same or a similar occupational classification.

The I-485J supplement is the document that often confirms continued job eligibility. Employers and workers should review the job title, duties, salary structure, and business unit carefully before assuming the move is safe.

A rushed transition can create avoidable problems if the I-140 is not secure or if the new role is materially different. Case strategy should also account for any recent requests for evidence, layoffs, or changes in corporate structure.
