Form I-539 is used by many nonimmigrants who need to extend a current stay or ask to change to another eligible status inside the United States. The basic question is not just which status the person wants next, but whether the current status is still valid and whether the requested category allows an I-539 filing.

Timing is often the most important issue. A filing should usually be prepared before the I-94 expiration date, with enough evidence to explain the purpose of the stay, financial support, prior compliance, and plans after the requested period ends.
