Form I-539 Change or Extension of Status: What to Review Before Filing

Form I-539 Change or Extension of Status: What to Review Before Filing

Form I-539 is used by many nonimmigrants who need to extend a current stay or ask to change to another eligible status inside the United States. The basic question is not just which status the person wants next, but whether the current status is still valid and whether the requested category allows an I-539 filing.

Timing is often the most important issue. A filing should usually be prepared before the I-94 expiration date, with enough evidence to explain the purpose of the stay, financial support, prior compliance, and plans after the requested period ends. Waiting until the last moment can create avoidable gaps and harder factual questions.

Not every immigration category uses I-539, and some dependents or employment-based cases may need a different strategy. Travel while a request is pending can also affect the case, especially when the filing asks USCIS to change status inside the United States.

Before filing, review the I-94 record, passport validity, prior approval notices, school or employer documents, and any past status problems. New Horizons Legal helps applicants evaluate whether an I-539 filing is the right path or whether another option is safer.

Immigration consultations available, subject to attorney review.
