I-864 Domicile When the Sponsor Lives Abroad

I-864 Domicile When the Sponsor Lives Abroad

A financial sponsor must do more than meet the income requirement on Form I-864. The sponsor must also be domiciled in the United States, or show a concrete plan to reestablish U.S. domicile by the time the intending immigrant becomes a permanent resident.

This issue often appears when a U.S. citizen spouse, parent, or adult child has been living overseas with the immigrant relative. A joint sponsor can help with income, but it usually does not fix the petitioner's own domicile problem.

Useful evidence can include a U.S. job offer, lease or home purchase, school enrollment for children, bank activity, voter registration, tax filing history, shipment of belongings, and proof that foreign employment or housing is ending.

New Horizons Legal helps families prepare I-864 domicile packets that connect the sponsor's documents to a realistic return plan.

Immigration consultations available, subject to attorney review.
