Special Immigrant Juvenile Status: Why the State Court Order Matters

Special Immigrant Juvenile Status can help certain young people who cannot safely reunify with one or both parents because of abuse, neglect, abandonment, or a similar basis under state law. The immigration case usually starts with a state court order containing specific findings USCIS will later review.

The state court order matters because it is not just background evidence. It should address custody or dependency, parental reunification, and whether returning to the young person’s country of nationality or last residence is not in their best interest. Missing or vague findings can create problems later.

Age and timing require careful planning. A young person must meet SIJS requirements at the right time, and state court jurisdiction rules can vary. Immigration filing strategy may also depend on visa availability and whether adjustment of status is immediately possible.

Before starting, organize birth certificates, parent information, school records, placement or custody documents, abuse or neglect evidence, and immigration history. New Horizons Legal helps families and guardians coordinate the state court and immigration pieces of an SIJS case.

Immigration consultations available, subject to attorney review.
